General terms and conditions for the use of eEducation Albert's services for consumers
These general terms and conditions are legally binding and constitute an agreement between you and eEducation Albert AB (Albert), reg. no. 559020-9093, regarding the use of the services that Albert provides via its platform(s) (the "Service"). In order to access the Service, you are required to agree to comply with these general terms and conditions. By activating your account and accepting these Terms and Conditions, you become bound by these Terms and Conditions.
Albert reserves the right to change these General Terms and Conditions; the General Terms and Conditions in force are available on Albert's website.
Albert provides a subscription service of digital learning apps designed to facilitate learning for children aged 3-16. The service is divided into different subjects, such as English and mathematics, and is also adapted for different ages. The subscription gives users access to Albert's learning apps including functionality, interface and content (including text, music, images, movies and underlying data and software) that Albert makes available through the Service on websites and in various applications.
To accept these Terms and Conditions, you must be at least eighteen (18) years old. If you are under eighteen (18) years of age, you need the consent of a legal guardian. The acceptance of these general terms and conditions is done via Mobile BankID.
In order to access the content of the Service, you need to register and create a user account. You can either choose to register via our website or via your app store. When creating a user account, you will need to provide an email address, a password, payment details, accept our terms and conditions and sign with a Mobile Bank ID. Your email address will also be used as your username. You are responsible for providing accurate information about yourself and for ensuring that no unauthorized person has access to your login details or password. You are responsible for ensuring that the email address you provide is correct and up to date, as the majority of communication regarding your subscription and purchases will be via email. Albert reserves the right to deny or terminate a user account in individual cases (for example, if you have provided incorrect personal information).
You can choose to add multiple user profiles to your user account. A subscription is intended for the person who has registered an account and can be shared with profiles as set out in these general terms and conditions. Profiles are intended to be people living together in the same household. This means that a profile cannot be someone who is not part of your household, such a person must register a separate account. Any additional profiles you link to your user account must comply with these General Terms and Conditions and you are responsible for ensuring that this is the case. The current price list for adding user profiles can be found on the Albert website.
In order to use the Service, you must have access to an internet connection. The Service is compatible on tablets and mobiles but cannot be downloaded to a desktop computer. Information on the version of the operating system required to use Albert's app can be found in the App Store and Google Play. Albert is not responsible for errors and/or delays caused by faulty equipment, software and/or internet capacity.
Albert reserves the right to change the technical conditions of the Service, which means that, for example, content, structure, functionality and search systems may change over time. Albert has the right to temporarily limit the availability of the Service for maintenance, support, upgrade or correction of errors. Albert's intention is to only perform such maintenance and the like at times when the Service normally has a low load.
If a change to the Service has not been notified by Albert at least one (1) month in advance and it significantly impairs your ability to use the Service (e.g. if your learning material is completely removed from the Service), you have the right to terminate your subscription early. In such a case, you also have the right to claim a refund of the subscription fee already paid up to a reasonable amount corresponding to the remainder of the current subscription period. You can only claim a refund if you also cancel your subscription. In the event that you continue to use the Service after a change has been made, you will be deemed to have accepted the change. Other than as set out above, you agree that you will have no liability or claim whatsoever against Albert as a result of the Service being modified in the manner described above.
For current subscription forms and pricing information, see the Albert website. All prices are quoted in Swedish kronor including the applicable VAT rate. Payment is made either monthly or annually.
For annual subscriptions, the subscription is extended by one year at a time unless it is cancelled before the end of the current subscription period. A reminder of when the subscription will be renewed will be communicated one (1) month before the subscription is automatically renewed via "my pages", through the Albert website. If the subscription is not cancelled before the subscription period expires, the subscription will be renewed and Albert will then charge for the following year.
For monthly subscriptions, the subscription is extended by one month at a time.
For new users, payment is made immediately upon subscription or, if you are taking advantage of a trial offer, at the end of the trial period if you have not previously unsubscribed. The end of the trial period is indicated in the confirmation email. Payment can be made with the available payment method or with a gift card. The subscription fee is then paid every 30 days for a monthly subscription or on an annual basis for an annual subscription. This means that the subscription will automatically renew and you will continue to be charged until you cancel your subscription. In case you paid with a gift card, the subscription will continue with the previously chosen payment method once the value of the gift card has been used up. In some cases, the time of debiting may change, for example if there are no funds available at the time of debiting. You can update your payment details by visiting our website and clicking on the "Membership and account" link.
If a payment cannot be made due to expiration of the payment card, insufficient funds available for payment or any other reason, and you do not update your payment details or terminate your account/subscription, Albert may suspend access to the Service until Albert has received payment. In the event of a failed payment, Albert is entitled to make further attempts to debit and if the attempt is not successful, Albert may terminate your subscription.
Albert offerst trial Periods for new users. The Trial Period can be for a monthly or annual subscription where you choose the type of subscription you want. In order to start a trial, you need to enter your payment details. By entering your payment details when signing up for the Trial Period, you accept that you will be charged the cost of continuing to use the Service at the end of the Trial Period. In order for you not to be charged the cost of continuing to use the Service, you need to cancel your subscription before the Trial Period expires. In the event that you do not cancel your subscription before the end of the Trial Period, Albert will charge you for the next subscription period based on the type of subscription you have chosen.
The Trial Period may only be used if you have not already had a subscription or used a Trial Period or similar offer before. This applies unless otherwise stated in the offer.
For trial Periods for Albert's annual subscriptions, a reminder will be sent via "my pages", through the Albert website. If the purchase is made via a third party (AppStore/Google PlayStore), you will receive information about your subscription from your app store. For Trial Periods longer than one (1) month, a reminder will go out one (1) month before. For Trial Periods shorter than one (1) month, a reminder will be sent no later than the day before the Trial Period expires.
To cancel a Trial, log in to My Pages, using the login details sent by email upon account registration. If the purchase is made via a third party (AppStore/Google PlayStore), go to your app store to account settings, under the tab "subscriptions" you will find your subscription and the option to cancel. You can also choose to contact support@hialbert.co.uk to cancel before your Trial Period ends.
Discount codes, gift cards, prepaid offers and other similar offers that provide access to the Service may be provided or sold by or on behalf of Albert.
You may choose to cancel your subscription at any time. If you cancel your subscription before the end of the current monthly or annual period, the subscription will only end when the current period has expired. A monthly period consists of 30 days and an annual period of 365 days. Termination takes place either via the Albert website or via Google Play/Apple Store. The termination must be made where the purchase of the Service was made and it is your responsibility to ensure that the subscription is terminated correctly. No compensation will be paid if the termination is not carried out correctly.
You must cancel your subscription before the end of the prepaid monthly or annual period, which means that a cancellation must be made no later than 23.59 on the day before the subscription is renewed. If a cancellation is not made, the subscription will be renewed for another monthly or annual period for which you will be charged the applicable monthly or annual fee.
You have the right to withdraw from your purchase within fourteen (14) days of accepting these General Terms and Conditions (withdrawal period) and receive a full refund. To exercise the withdrawal period, you can submit the Withdrawal Form (see Appendix 1) or contact Albert's customer service, for contact details see paragraph 17 below. The form for exercising the right of withdrawal can also be found on Albert's website. If the Service is defective or incorrect, you can contact Albert's customer service and make a complaint.
When you exercise your right of withdrawal, you will no longer have access to the Service and your account will be automatically terminated. Refunds will normally be made within 5-10 days of us receiving notification of the exercise of the right of withdrawal.
Refunds are only made in cases where customers have had problems with the Service that are beyond their control and the prevented use is based on an error by Albert. No compensation is paid in cases where you as a customer have forgotten to cancel your subscription.
All content provided by Albert through the Service is owned by Albert or Albert's content providers and is protected by copyright or other intellectual property rights. By creating a user account and paying the fee, you obtain a non-exclusive, non-transferable, limited license to the Content on the Service to use in accordance with these Terms and Conditions. All copyrights and other intellectual property rights covered by the Service and made available to you remain the property of Albert.
As a user, you may use the Service and access other content in the Service in accordance with these General Terms and Conditions during the subscription period. The Service is for private use only and may not be used for any commercial or public purpose or purpose. Your account is personal and you may not share it with others, except with the profiles that you have added as additional profiles to your user account in accordance with these General Terms and Conditions and the applicable price list.
You may not otherwise use the Service in a manner that is contrary to these Terms and Conditions or for any illegal purpose. Nor may you encourage anyone else to make such use in violation of law or these Terms and Conditions. As a user of Albert's Service, you are responsible for ensuring that your reviews/tips comply with applicable legislation and do not use words or expressions that may be perceived as discriminatory, offensive or offensive in forums that may be associated with Albert's. If Albert deems that your reviews/tips are perceived as discriminatory, abusive or offensive, Albert has the right to block your access to comments and also terminate your subscription.
If you suspect any unauthorized use of your account, you must immediately notify Albert and change your password. You are responsible for any damage caused by you giving someone else access to the Service through your user account. Albert has the right to immediately terminate your subscription or block access to the Service if Albert has reason to suspect that your account is otherwise misused by any unauthorized person.
In order to deliver the Service, Albert needs to process necessary personal data, such as your name, e-mail and payment details. We always process your data in accordance with the EU General Data Protection Regulation ("GDPR") and supplementary legislation. Read more about how we process your personal data in our privacy policy which you can find on Albert's website.
We may use your data for marketing our products or services. The marketing may relate in whole or in part to the products or services of another group company. This means that you may receive targeted advertising based on the information you provide. If you do not want to receive direct marketing, you can contact us at support@hialbert.co.uk and request a block against direct marketing (so-called direct marketing block). You can also choose to unsubscribe directly in the email from these mailings.
If a dispute arises between Albert and you, the parties shall first try to resolve the dispute by mutual agreement. If the parties cannot agree, the dispute shall be settled in Swedish courts.
